NEW ORLEANS (WVLA) — The man accused of sexually assaulting an LSU fan in the French Quarter after the BCS Championship game earlier this year was sentenced today.
WDSU-TV in New Orleans reports that Brian Downing, 33, pleaded guilty to two counts of obscenity and was sentenced to two years by Judge Karen Herman. She recommended Downing to enter the boot camp program because he is a “bully” who has permanently damaged someone else’s life.
"That one act, thanks to social media, will be permanently branded to that person," Herman said.
The incident first made headlines back in January after a video of the incident was released on YouTube. The victim, an LSU fan, appeared to be unconscious at a table in the Krystal Burger on Bourbon Street. Alabama fans in the store proceeded to mock the young man, adorning him with garbage and placing their fingers in his ears and nose. Then, it shows a man placing his genitals on the face of the sleeping man.
Several days later the video became viral and caught the attention of media outlets and the New Orleans Police Department official began to seek a suspect. Downing eventually turned himself in to police.
Downing pleaded guilty back in October 2012 for the two charges. He was originally charged with Sexual Battery, but that charge was dropped as a part of a plea deal. Also part of the plea deal is that Downing will not have to register as a sex offender.
